SeedFi’s Federal Privacy Notice applies to applicants for, and borrowers of loans, lines of credit, or other products offered by SeedFi or its banking partners through SeedFi. In addition, Cross River Bank’s Federal Privacy Notice and Privacy Policy applies to applicants for, and recipients of, loans, lines of credit, or savings accounts offered by Cross River Bank through SeedFi.

SeedFi’s Privacy Policy

This Privacy Policy describes the ways SeedFi collects, uses, shares, and protects your personal information with respect to your use of our Site. When sites are posted by SeedFi, the site will link to this Privacy Policy, and this Privacy Policy applies. When sites are posted by third parties, the Privacy Policy of the third party applies, and this Privacy Policy does not apply.

Our Site may contain links to other websites. This Privacy Policy applies only to information collected on our Site and does not govern the information practices or the content of other websites. By accessing our Site, using SeedFi’s products and services, or creating an account on our Site, you acknowledge that you have read, understood, and agree to our Privacy Policy. 1. What Information We Collect

SeedFi may collect your personal information if you decide to apply for a loan or line of credit on our website or mobile application. The information includes the following:

  • Your name, address, phone number, email, date of birth, social security number and documents or other media that verifies your identity such as your driver’s license, passport, and photographs of self (“selfies”);
  • Information such as your credit history, credit scores, and other information provided by consumer reporting agencies;
  • Information about your loan account and your payment history;
  • Information we receive from third party data partners for verification purposes including to verify your identity and manage risk;
  • Your bank information such as your bank, your account numbers, bank account credentials, and transaction information;
  • Information about your employer, current income, assets, and certain expenses, including with respect to your current employment, bank account credentials, and transaction information;
  • Information about your computer, mobile phone or other access device and anonymous information about your web request, Internet Protocol (“IP”) address, geolocation data, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Site, domain names, landing pages, pages viewed, your use of third-party applications, and other information that assists us in analyzing and improving our service.

Providing your personal information is entirely optional.

2. How We Collect Information

We collect information about you using the following means:

  • Directly from you when create an account and use SeedFi’s website or mobile applications; fill out forms or fields such as when you request a loan offer; through the services you opt in to, such as when you choose automatic bank account verification; from your transactions, including your loan or line of credit repayments, savings account withdrawals; and your communications with us.
  • Automatically from you when you visit the website or use our mobile applications:
    • We collect certain information from your computer, mobile phone, or other access device that is automatically reported by your browser or mobile device each time you access the website;
    • We automatically record certain log file information such as IP address, browser type, and what you do on our website;
    • We may also employ clear images (also known as web beacons), which are used to anonymously track the online usage patterns of our users;
    • We may also use clear images in HTML-based emails sent to you to track which emails are opened and which links are clicked by recipients;
    • We may place small data files called cookies on your computer or other device.
  • From third-party service providers including information we request on your behalf from credit reporting agencies such as TransUnion, Equifax, and/or Experian, information we receive from third party data partners, which supplement and/or verify information we collect from you, and information we access from public records or websites.
  • From third-party referral partners that you engage with, which may pass certain information about you and your use of their service to us. This information could include any information that you have permitted the third party to share with us, and any information you have made public in connection with that service. You should always review and, if necessary, adjust your privacy settings on third-party websites and services before visiting the Site.
  • From third-party service providers that use cookies or other identity technology for the purposes of targeted advertising. Such third-party service providers may collect information in which case their respective privacy policies may apply.

3. How We Use the Information We Collect

We use the information we collect about you for the following purposes:

  • provide you with access to the products offered through the Site;
  • evaluate your creditworthiness, if applicable;
  • improve our insights about customer behavior and preferences so we can tailor our content and advertising;
  • provide notices and other information to you about, or in connection with, SeedFi’s products;
  • provide customer support;
  • detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; fulfill legal requirements; and enforce our agreements;
  • identify and repair errors that impair existing intended functionality;
  • provide, maintain, develop, and improve our services, your experience, and to protect SeedFi and its users; and
  • improve your experience accessing the Site by recognizing you as a customer and remembering information you previously provided so that you will not have to re-enter it.
4. What Information We Share

All financial companies must share customers’ personal information for everyday business purposes. Subject to any applicable legal exemptions, we may share your personal information with the following parties:

  • Service providers that help with parts of our business operations such as fraud prevention, servicing, debt collection, marketing and technology services, and nonaffiliated financial institutions that we partner with to market or provide the products or services to you;
  • Credit reporting agencies to report account information as permitted by law;
  • Law enforcement, government officials, or other third parties when we are compelled to do so by a subpoena, court order, or similar legal procedure, or when we believe in good faith that disclosure is necessary to comply with law, protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
  • Companies that we merge with or are acquired by, or companies we plan to sell, divest, or transfer all or a portion of our business, assets, or products to, including any back-up service provider or back-up administrator we or any creditor engage with, in the event we stop operating;
  • Other third parties, such as debt settlement agencies, but only if you consent or direct us to do so.

If you select a loan offer and sign a credit agreement, your loans may automatically be allocated to investors. Investors may purchase your loan directly from us. We provide information about you included in your application, including personally identifiable, financial, and credit information, and your loan terms to these investors and their agents and trustees.

SeedFi does not sell or rent any of your personal information to third parties.

5. Do Not Track

We do not process or respond to “do not track” signals or other similar mechanisms.

6. Links to Third-Party Services

If you elect to use Plaid Technologies, Inc. (“Plaid”), you acknowledge and agree that Plaid will collect and use personal information from financial institutions in accordance with Plaid’s privacy policy.

If you elect to use Argyle Systems Inc. (“Argyle”), you acknowledge and agree that Argyle will collect and use personal information from third-party workforce platforms in accordance with Argyle’s privacy policy.

7. Security

We are committed to protecting the confidentiality of your information and online transactions. We maintain physical, electronic, and procedural safeguards designed to protect your personal information. We have security procedures in place to safeguard against loss, theft, unauthorized access, destruction, misuse, and modification of this information after we receive it. For example, we restrict access to the information to our employees, agents, and contractors that need to know it to provide products or services to you. We follow generally accepted standards designed to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. 8. Behavioral Targeting

We use Google AdSense to display advertising on our website and to manage our advertising on other sites. Our ad network partner uses cookies and web beacons to collect non-personally identifiable information about your activities on this and other websites to provide you targeted advertising based upon your interests. If you wish to not have this information used for the purpose of serving you targeted ads, you may opt out by clicking here. Please note, this does not opt you out of being served advertising. You will continue to receive generic ads.

9. Children's Privacy

Our products are intended for use by individuals who are at least 18 years old. You represent and warrant you are at least 18 years of age and that you possess the legal right and ability to use this site. If you are under the age of 18, you should not use our Site.

We do not knowingly collect or retain personal information from children under the age of 13. If we learn that we have collected personal information from a child under age 13, we will delete that information promptly. If you believe that we might have any information from a child under 13, please contact us at help@seedfi.com.

10. Testimonials

With your consent, we may post your testimonial along with your name. If you want your testimonial removed, please contact us at help@seedfi.com.

11. If You Access from Outside the United States

If you reside outside the United States, you understand and agree that any information you provide to us will be transferred from the country of your residence or location at the time it was provided to the United States. If you do not want your personally identifiable information to be transferred to the United States, do not provide that information to us. By providing us with your information, you consent to the transfer of your information to the United States.

12. Changes to this Privacy Policy

We reserve the right to change this Privacy Policy at any time. If we make changes to this Privacy Policy, we will update the “Effective Date” at the bottom of this page. Your continued use of the Site after any changes are posted will be deemed to constitute your agreement to and acceptance of such changes to this Privacy Policy. California Privacy Notice

If you are a California resident, the California Consumer Privacy Act of 2018 (the “CCPA”) requires us to provide you with certain notices prior to our collection and use of your personal information.

This notice for California residents under the CCPA supplements the information provided in the rest of this Privacy Policy, which also applies to you. Any terms defined in the CCPA have the same meaning when we use them here.

We may collect personal information about prospective, current, and former SeedFi customers. In addition, we may have collected the following categories of personal information from consumers in the last twelve (12) months:

  • Identifiers;
  • Characteristics of protected classifications under California or federal law;
  • Customer records;
  • Commercial Information;
  • Internet or other similar network activity;
  • Audio, electronic, visual, thermal, olfactory, or similar information;
  • Geolocation data; and
  • Professional or employment-related information.

SeedFi does not “sell” any personal information we collect. We share personal information with the categories of third parties described in the “What Information We Share” section above

Your Rights and Choices under the CCPA

Subject to certain exemptions, California residents have the right to request to know details about the categories and specific personal information we collect, to delete their personal information, to opt out of “sale” of personal information that may be occurring, and to be free from unlawful discrimination for exercising these rights under the CCPA.

Financial regulations, including the Fair Credit Reporting Act (“FRCA”) and the Gramm-Leach-Bliley Act (“GLBA”), may prevent us from disclosing or deleting certain information that may be requested by California residents.

How to Exercise Your Rights under the CCPA

If you are a California resident, you may make a request to exercise your rights under the CCPA by either of the following methods:

Before responding to a request, we will request information from you, which at a minimum will include your full name, date of birth, and email address, and any additional information to verify your identity. Under the CCPA, you may have an authorized agent submit a request on your behalf, and we will collect certain authorization and verification information from you and your authorized agent.
